This summer, McDonald’s wants to celebrate good times, so as part of their summer-long #hellogoodtimes campaign I’m currently giving away eight sets of four tickets to Key103 LIVE festival this Saturday, 16th July,  in Manchester. As well as this, over the summer McDonald’s will have a good times squad bringing the ‘good times’ atmosphere to life in restaurants and cities across the UK with instant-win prizes and free fun experiences.

McDonald’s Key 103 Summer Live Festival Tickets 2016 Promotion Ts&Cs:

These are the Rules (“the Rules”) for the McDonald’s Key 103 Summer Live Festival Tickets 2016 Promotion (the “Promotion”):


1. The promoter of this Promotion is McDonald’s Restaurants Limited of 11-59 High Road, East Finchley, London, N2 8AW (“McDonald’s”).
2. Each person who enters the Promotion (each an “Entrant”) unconditionally accepts and agrees to comply with and abide by these Rules and the decisions of McDonald’s, which shall be final and binding with respect to all aspects of the Promotion. Winning any prize requires that the Entrant whose entry is selected as the potential winning entry for the prize is, and remains, in compliance with the Rules. Until such compliance is completed and verified as solely determined by McDonald’s, the Entrant is not a winner.
Eligibility
3. The Promotion is open to UK, Isle of Man or Channel Islands residents aged 18 or over. The following are not eligible to participate: (i) employees, franchisees and employees of franchisees of McDonald’s and their immediate families and anyone professionally connected with the Promotion; (ii) employees of any company responsible for redemption of prizes/vouchers or for supplying prizes for the Promotion and their respective franchisees, subsidiaries, agents and advisors; (iii) other persons assisting with this Promotion; (iv) any person not being an individual natural person; (v) any syndicate or collection of persons acting in concert; and (vi) any person entering via an agent or using the services of or which is an entity carrying on the business of entering (or advising on entering) prize promotions.
4. All entries must be made directly by the person entering the Promotion. Entries made using methods such as a computer macro, a script or the use of automated devices or processes are not allowed and all such entries will be disqualified.
Entry
5. Promotion start date: 12 July 2016 at 15:01 BST. Promotion closing date: 14 July 2016 at 11:59 BST.
6. To enter the Promotion, Entrants must retweet the official Promotion tweet, as posted by @EmsyPickle. Replies and other messages will not be counted.

7. One entry per person. Entries made by anyone found to be using multiple Twitter accounts for the purposes of entering the Promotion shall be ineligible.
8. No purchase necessary to enter or win.
9. The entry must not infringe upon the copyright, trade marks, rights of privacy, publicity or other intellectual property or other rights of any person or entity.
10. Once the Promotion has closed, the winners shall be selected at random using a computer program producing a verifiably random draw from all correct and valid entries submitted.
11. The winners will be notified by McDonald’s as a response to their entry on Twitter within 24 hours of the Promotion closing date and time and shall be asked to send a private message to McDonald’s with their full name, date of birth, telephone number, postal address, and email address, as well as any other details requested (the “Winner’s Response Message”). If a winner fails to submit this information within 24 hours of being notified as a winner, McDonald’s reserves the right (in its sole discretion) to forfeit the prize or draw an alternative winner.
12. Odds of winning may depend on the number of eligible entries received. McDonald’s shall not be obliged to contact any unsuccessful entrant.
13. No responsibility will be accepted for any technical or other difficulties in entering or any entries delayed or corrupted.
14. Entrants are responsible for all costs and expenses relating to participation in the Promotion, such as the cost of accessing the internet.
15. McDonald’s reserves the right to exclude any entries which it believes to be fraudulent or based on misconduct, or if, in its reasonable opinion, it considers that there is a significant risk that the Entrant may bring the McDonald’s brand into disrepute.
Prizes
16. There are eight (8) prizes available in total. Each prize comprises the following:
- A set of four (4) tickets for Key 103 Summer Live taking place on Saturday, 16 July 2016 at Manchester Arena (for 1 winner and 3 companions).

17. Please note:
- Accommodation is NOT included in the prize;
- Personal spending money is NOT included in the prize;
- Travel expenses to and from the event are NOT included in the prize; and
- Food and drink are NOT included in the prize.
18. Use of tickets is subject to the standard Key 103 Summer Live Terms and Conditions. Winners must comply with these Terms and Conditions in order to take-up their prize. McDonald’s reserves the right to verify the age of all winners and companions (all must be 18+).
19. Any person in violation of the venue’s or promoter’s terms of entry will be refused entry to or expelled from the event with no right of compensation. Further details available upon request.
20. Prize includes only those items listed and does not include: accommodation, transportation, car rental or rentals, expenses of any kind, personal, medical, health, hospital, travel and trip cancellation insurance, taxes and fees, gratuities, communication charges, beverages (including alcoholic beverages), souvenirs, sightseeing and any other expenses not expressly stated above. The winner will be exclusively responsible for any potential taxes due as a result of being awarded a prize.
21. All costs associated with prize acceptance and use not specified in these Rules as being provided are the sole responsibility of the winner. Winner and companion must comply with all venue and promoter rules and regulations. Failure to do so may result in forfeiture of such portion of prize. Winner may not substitute, assign or transfer the prize, but McDonald’s reserves the right, at its sole discretion, to substitute a prize with one of comparable or greater value.
22. McDonald’s is not responsible for any cancellations, delays, diversions or substitutions, or any act or omissions whatsoever by the event operators, third party prize providers or any other persons involved in providing any prize-related goods or services.
23. The prize, if won, could result in time off work or study. Entrants should ensure prior to entering the Promotion that they (and their companion) are able to take this time off work or study, where necessary. It is the sole responsibility of the winner to arrange time off if necessary.
24. All prize details are at McDonald’s sole discretion. Where applicable, winner and companion are responsible for having any required travel-related documents (including valid photo ID and any required passport or visa) prior to departure as well as fulfilling any/all travelling requirements.
25. In order to claim their prize, any winner may be asked for identification that matches their entry details. McDonald’s reserves the right to validate any claim and may ask for proof of identity and/or address and/or age.
26. Prizes may not be exchanged for any cash or other alternative, are not transferable, divisible, permitted to be sold or resold and are not for use in conjunction with any other promotion or offer. Prizes cannot be replaced or refunded in the event of loss, theft or missed opportunity. In the event that McDonald's wishes to increase the prize pool for the Promotion, it may (but shall not be obliged to) do so.
27. All prizes which are un-awarded, unclaimed or subject to claims which become invalid or which are adjudged void at any time, will lapse and may be re-awarded by McDonald's (but without obligation to do so). This includes any prizes where the Winner’s Response Message is received by McDonald’s after the timeframe provided for response. McDonald’s does not accept any liability for delay or non-delivery of notification emails to winners or Winner’s Response Message.
28. A list of the names and counties of prize winners may be posted by McDonald's on its website, but if not, details can be obtained by contacting the Customer Services number notified onwww.mcdonalds.co.uk and obtaining the contact name and address to which to send an envelope with a signed hand-written specific request and a stamped addressed envelope.
29. To the fullest extent permitted by applicable law, the prizes will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
Release and liability
30. As a condition of entering, Entrants agree that to the extent permitted by law, McDonald’s, Twitter, and their respective parent companies, subsidiaries and affiliated companies, franchisees, prize providers, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (the “Released Parties”) are released, will have no liability whatsoever for, and shall be indemnified and held harmless by Entrants against any liability for any losses or damages of any kind, including damage to property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize or participation in this Promotion, submission of an entry, McDonald’s use of an entry, or any Promotion-related activities, including any prize-related travel. Nothing in these Rules shall be construed to limit or exclude any liability of a Released Party for fraudulent misrepresentation, fraud, death or personal injury caused by a the Released Party’s negligence or any other liability to the extent the same may not be excluded or limited as a matter of law.
31. To the fullest extent permitted by law, McDonald’s excludes all liability for any costs, expenses, loss or damage including indirect, consequential or economic losses arising (whether in contract, tort or otherwise) out of or in connection with Entrants’ participation in the Promotion, entry into these Rules or receipt or use or misuse of any prize.
Privacy and publicity
32. All winners agree to take part in reasonable, unpaid publicity on behalf of McDonald’s including being announced as a winner on the McDonald’s website and social media accounts along with their first name and prize. Such publicity and advertising may take place at any time or date after the entry has been submitted. No further consideration will be given for this.
33. By submitting an entry, the Entrant consents to the potential use of the Entrant’s entry in McDonald’s marketing and promotional material, including in any online or TV advertising.
34. In administering this Promotion, McDonald's may collect personal information from any Entrant and, unless it has first obtained the Entrant's consent, McDonald's: (i) will not collect more of the entrant's personal information than needed for the purpose of administering and analysing this Promotion (including carrying out security checks as stated) and for posting features on its website which are informed by one or more entry-submissions; and (ii) will only use the Entrant's personal information for those purposes (and such use may include transferring the Entrant's personal information to McDonald's respective associates for the purposes of security and monitoring.) By accepting these Rules, Entrants consent to their data being transferred to, stored and processed in a destination outside the European Economic Area.
35. Any enquiries about personal information held by McDonald's, including any request for deletion of personal data, may be made by contacting the Customer Services number notified on the Contact Us section of www.mcdonalds.co.uk and obtaining the contact name and address to which to send an envelope marked "Data Protection Request".
36. As well as details of names and counties, each Entrant agrees that McDonald's may publicise statements made by or attributed to any Entrant relating to McDonald's in connection with a prize, together with the Entrant's likeness and background, unless otherwise requested.
Twitter
37. Entrants acknowledge and accept that Twitter is not associated with the Promotion, does not act as a sponsor or promoter of the Promotion, nor does it endorse or administer such Promotion in any manner. Use of Twitter remains subject to each service’s particular terms of use and privacy policies which entrants must agree to and comply with at all times in connection with their participation in a Promotion.
38. Entrants must have a valid Twitter account and be logged in to their account to enter. Entrants who tweet their entries using a wireless device may be charged according to their rate plans with their wireless carriers.
39. McDonald’s is not responsible for any changes or unavailability of the Twitter service that may interfere with the Promotion or ability of Entrants to timely enter, receive notices or communicate with McDonald’s via Twitter, in which case McDonald’s, in its sole discretion, may terminate or modify the Promotion.
General
40. McDonald's may: (i) extend any time limit or waive any of the Rules where a person might otherwise have been disqualified (without obliging McDonald's to relax the Rules on any further occasion for that Entrant or at all for any other person); (ii) terminate, extend or suspend the Promotion at any time where this is necessary or desirable due to supervening circumstances beyond McDonald's control; and (iii) substitute a product deemed to be an appropriate replacement and of equal or greater value in the place of any of the prizes (or any part of a prize to the extent divisible). McDonald's decision in the exercise or interpretation of any of its rights or discretions in connection with these Rules shall be final and binding and no correspondence shall be entered into.
41. McDonald’s reserves the right at its absolute discretion to disqualify Entrants that do not comply with these Rules or the spirit thereof or any Entrant who it reasonably believes has interfered with the fair running of the Promotion.
42. No term of these Rules shall be enforceable by any person who is not a party to them, save that, to the extent McDonald's deems it appropriate, McDonald's shall be entitled to treat any of its rights under the Rules as having been granted for the benefit of McDonald's, its group companies, and one or more of its agencies and commercial partners.
43. These Rules shall be exclusively governed by and construed in accordance with the laws of England and the courts of England and Wales will have exclusive jurisdiction in the event of any dispute arising in connection with the Promotion or these Rules.
